Legal Articles

Q1. Child Maintenance Denied by Court. I am a working mother and earn more than my husband. During my divorce proceedings, the court denied my maintenance claim for my daughter. Is this judgment valid?

Advocate Riddhi Shah answered:
The father is required to contribute towards the child’s maintenance. The order can be challenged, as the father cannot be completely absolved of his duty to maintain the child.

Q2. Property Bought in Mother’s Name – Want to Transfer It to My Name. I purchased a commercial property in my mother’s name. Now I want to legally transfer the property to my name. What is the best way to do this so that I do not face problems from my brothers or relatives in the future?

Advocate Riddhi Shah answered:
A Gift Deed or Release Deed may be executed. A regular transfer deed can also be prepared and registered, but it may involve higher stamp duty and registration charges. The Gift Deed should be properly stamped and registered.

Q3. Does a New Will Revoke an Old Will if the First Will Was Registered? If a person has a registered Will and later prepares a new Will revoking all previous Wills, which Will will be valid? Can a person transfer all their self-acquired property to their children without the consent of their surviving wife? Can the wife or another child challenge such a Will?

Advocate Riddhi Shah answered:
A validly executed later Will generally prevails over an earlier Will. A person can generally bequeath their self-acquired property to anyone they choose. However, a wife or other legal heir may challenge the validity of the Will on grounds such as fraud, coercion, undue influence, or other grounds depending on the facts of the case.
