Q1. Is a parking allotment letter sufficient as a legal document, even if it is not included in the sale. Hello Sir, I booked a new flat a month ago without car parking, and the sale agreement has been completed. The bank has also disbursed the loan amount to the builder. Now, the builder is offering a covered car parking space and is willing to sell it, but he says he will only provide an allotment letter and will not amend the agreement. Could you please advise on the following: Is a parking allotment letter for covered car parking sufficient as a legal document if it is not included in the sale agreement? Is it possible to amend the agreement to include the covered car parking without increasing the agreement cost? Does the society have any rights to change the parking allotment in the future? Hello, I would answer all your queries in chronological order. Very firstly, it is very important to have a sale agreement for your parking because only the allotment letter is not enough. There was a landmark judgement passed in 2017 by the apex court wherein they mentioned the need for the parking agreement. The answer to the second query is yes, you can always amend your agreement, and that is known as a supplementary agreement. In this way, you can always add or subtract the clauses as per your need. And lastly, the society doesn’t have any right to change the parking in any manner.
Q2. Complaint againt builder for delay in possesion. I have booked a flat in Discovery in malad west March 2016 and it was to be delivered in September 2018 and till date, the project has not even started and the builder is not returning my money. Where can I file a complaint about project delay? Can I file a consumer complaint?

Q3. Delivery of faulty mobile phone from an online shopping website. I brought a mobile phone on 13th of June from an online shopping website, after using it for 18 to 20 days it got switched off automatically so I went to the service centre. they found that the battery shield is missing,and they concluded that I have got a faulty product from the website. then directly I made contact with website by calls and emails but the replacement period was over until then so they told me to contact the phone company again,but when I made contact with the phone company to get service in warranty period they mentioned that as a part of mobile is missing it becomes a case of physical damadge so it cant be repaired under warrenty and as I got the mobile faulty from the website it is none of there concern about it and I should contact the said website.now as it is fault of the website I want to file case on them .as they are not resolving my issue from 2 & half months, and they also closed the complaint which was filed by me online on consumer forum.so now want guidance for sending notice.
