Q1. Is a Gazette notification necessary, or would an affidavit be enough? My mother’s official name is Meena Arjun Ghule, but in some of my documents her name is mentioned only as Meena, while other documents contain her full name. What should I do? Could this difference cause issues later with employment or visa applications?

Advocate Neelkanth Goswami answered:
A Gazette notification is generally needed in cases involving a name correction or an actual change of name. Since there has been neither a change nor an error in your mother’s name in this case, it should ordinarily not result in any future difficulty. The main issue is that her name has been recorded in an abbreviated form on certain documents. Whenever necessary, your mother may execute an affidavit confirming that her complete and correct name is Meena Arjun Ghule.

Q2. Where should I file a contested divorce case? I am originally from Pune and currently have a DV case pending. I am a government employee and am transferred once every three years. My wife is unemployed, and we have one child. She is unwilling to agree to divorce and is demanding a significant amount of money. I am prepared to pay maintenance as determined by the court, but she is demanding considerably more. If my next posting is in Gadchiroli, can I file the divorce petition there? Would filing in Gadchiroli increase the possibility of obtaining an ex-parte divorce or make it more difficult for my wife to seek a transfer of the case? Should I file in Pune or Gadchiroli?

Advocate Neelkanth Goswami answered:
Under the applicable law, a divorce petition can ordinarily be instituted in any of three places. The first is the place where the marriage took place. The second is the place where the parties last lived together as husband and wife. The third is the place where either spouse is presently residing. If you initiate the divorce proceedings in Gadchiroli, your wife may potentially object to the jurisdiction of that court. She may also be entitled to request that the divorce proceedings be transferred to the place where she resides.

Q3. The cheque amount and the amount stated in the legal notice are different. Can proceedings under Section 138 of the Negotiable Instruments Act still be maintained when the dishonoured cheque was for ₹5,27,850, but the legal notice demanded ₹5,27,650? The notice was returned because the address could not be located. However, an earlier notice issued before the cheque was dishonoured was successfully received at the same address and mentioned the cheque amount of ₹5,27,850.

Advocate Neelkanth Goswami answered:
Under the law, the legal notice should be dispatched to the concerned person’s last known address. Where the notice has been sent to the last known address, it may be considered sufficient for the purpose of service. If previous correspondence was successfully delivered to the same address, that fact can also be placed before and established before the court. As an additional precaution, the notice can also be sent through email and WhatsApp. In relation to WhatsApp communication, double blue ticks showing that the message has been read may be relevant and can potentially be relied upon as evidence of service.
