Q1. Is Physical attendance required for fixing schedule in trial court? I’m facing trial in sessions Court for sections 313 IPC. Two months back, charges have been framed. Next hearing is for fixing schedule. Is it mandatory for accused to appear for that particular hearing of fixing of schedule or our engaged lawyer can manage it ??as I couldn’t attend next hearing From last 2 hearings, judge is posting schedule fixing for next hearing and so on. Is that judge fix schedule next hearing or will it be again postponed. Any time limit fixed for that?

Yes your presence is mandatory and you can apply for exemption of apperance so being there on every date is not necessaru provide your lawyer is present you remain present when court orders. You need texceptional situation to get exemption.

How does the court treat fatal errors on date and time of the incidence and also description of dress worn by the complainant recorded on FIR and remand notice. the error is so fatal that it completely changes the importance of a NC which was filed before the manufactured Pocso sec12 case was even registered.
