We got married just one year ago in an arranged marriage, but within three months, I found that she has psychological problems. In the meantime, she became pregnant, and I was waiting for the delivery. She is also a sex addict. I tried to take her to a doctor, but she refused. She is a BAMS doctor as well, but she is not working.

Now I do not want to bring her back and want to know what will happen if I send her divorce papers. I also want to have access to my child. You may, as per Muslim personal law and applicable customs, pronounce divorce in the presence of two witnesses. You should formally prepare the divorce document, preferably with appropriate legal assistance, and provide a copy to your wife while retaining a copy for your records. The document should clearly state the circumstances and reasons for the divorce. Regarding the custody of the child, you will need to produce strong evidence in your favour if the matter is taken before the Family Court.

Q3. Bail Forfeited in Dog Bite Case. I have a case relating to a dog bite registered against me in the Magistrate’s Court in Mumbai in 2010. I am now a resident of Pune and am unable to attend court due to medical reasons. The Magistrate has forfeited my bail and issued a Non-Bailable Warrant (NBW) against me. I do not want to pay the bail amount again and want to make an application before the Magistrate seeking exemption from personal appearance on medical grounds. I have medical reports to support my case. Also, is it possible for me to file a fresh suit in Pune to quash this complaint? Please advise.

You can file an application seeking permanent exemption from personal appearance and request cancellation of the NBW without personally appearing before the Magistrate’s Court in Mumbai. In Arunkumar N. Chaturvedi vs. The State of Maharashtra and Anr., the Bombay High Court laid down a principle that the accused need not necessarily be personally present for the cancellation of an NBW. For permanent exemption from personal appearance, you may be required to submit an application under Sections 205 and 317 of the Code of Criminal Procedure (CrPC), along with the relevant medical certificates and supporting documents.
