Q1: How can my brother transfer his share of the property to me? I am seeking information regarding the documentation and procedure for transferring ownership of a property. We have an independent house in Nagpur that is currently in my mother’s name. Both my parents passed away in 2013, and I have one younger brother. I would like to understand the process, documents required, and costs involved in transferring the property. If my brother agrees to transfer his share in the property to me, can it be transferred directly into my name? If yes, what would be the procedure?

There are several possible options. Firstly, your brother may execute a Release Deed in your favour. Secondly, he may transfer his share to you through a Gift Deed. Thirdly, you and your brother, along with the other concerned family members, may enter into a Family Arrangement. Any of these options may be considered depending on the circumstances. The applicable stamp duty and registration charges will vary according to the option chosen.

Q2: Society is creating an issue regarding ownership. Should I execute an affidavit or confirmation deed? A sale deed between the brothers was executed in 1993, but it was not registered and the applicable stamp duty was not paid. Based on that transaction, the flat was transferred to the elder brother, and an indemnity bond was also executed at that time, which was used for completing the documentation. After around 23 years, the society has raised an issue stating that the elder brother is not the actual owner of the flat and is only a nominal member. We have submitted the relevant documents to the adjudication department for payment of stamp duty and are still waiting for their response. In the meantime, the younger brother has passed away. I would like to know whether we should execute an affidavit or proceed with a confirmation deed.

Your question requires some clarification. However, if the property was transferred or gifted by one brother to another, the transaction was required to be properly registered. For the purpose of society membership, you may submit an affidavit along with an indemnity bond. However, the ownership and title of the property should be properly established and cleared to avoid potential title-related issues in the future.
