Q1: The drawer has stopped the payment of cheque, what to do?
Advocate Amrut Vishwas Tigade answered:
If the cheque was issued towards a legally enforceable debt or liability and has been dishonoured due to a “payment stopped by drawer” instruction, you may have a remedy under Section 138 of the Negotiable Instruments Act, 1881, subject to the facts of the case. A statutory legal notice should generally be issued to the drawer within 30 days from receiving information from the bank regarding the dishonour of the cheque. The drawer gets 15 days from receipt of the notice to make the payment. If payment is not made within this period, a complaint under Section 138 may be filed before the appropriate court within one month from the date on which the cause of action arises. It is advisable to preserve the cheque, bank return memo, payment records, agreement/receipts and other relevant documents.

You may make an application for a certified copy of the order before the concerned department of the High Court. You should also check with the concerned department regarding the status of the order and whether it has been dictated, signed and uploaded on the High Court website. Since the order directs the court officers to issue the Probate, it would also be advisable to verify with the relevant Probate/Registry department whether any procedural requirement, documentation or further application is pending.
