Q1. Divorce Advice for Husband and Wife Separation Procedure. I have been married for four years and have a three-year-old son. My wife and I frequently fight due to several issues, including our physical relationship and household responsibilities. I am frustrated and want to know how we can separate.

You can file for divorce under Section 13 of the Hindu Marriage Act on the ground of cruelty. Denial of a physical relationship without a valid reason may, depending on the circumstances, be considered a ground for divorce. It is preferable to first try for mutual consent divorce. If that is not possible, you may proceed with a contested divorce.
Q2. Property Issue with My Sister. Can my sister claim a share in my mother’s property, which was purchased by my father in my mother’s name?

Your mother’s rights depend on the nature and ownership of the property and the applicable law. Your sister’s rights will also depend on these factors. The relevant property documents and succession laws should be examined before determining her share.
Q3. All Flats Sold but Builder Has Not Formed Society. Our RERA-registered project started in 2014. More than 51% of the flats were sold, but the developer has still not formed the co-operative society. The project remains incomplete despite the RERA extension. What can we do?

Under Section 11(4)(e) of the RERA Act, 2016, the promoter is responsible for taking steps to form the required association or society. If there is a delay in possession beyond the date promised in the registered agreement, the allottees may have remedies under Section 18 of RERA, including interest or refund with interest, depending on the circumstances.
