Q1. Can society ask to pay for cultural fund in housing society, is this legal ? Our housing society is charging Rs. 100/- per month, levy against Cultural activities fund. can housing society collect celebration funds as part of monthly maintenance? What if I am not interested to pay for this purpose, please? advice.

Dear, There is no such provision in law as applicable that society can make it mandatory to charge such contribution under the head “for cultural activities fund.” It is totally optional / voluntarily and depends on you to contribute or not to because there is no such separate head as “Cultural Activity Fund” under the Society Maintenance Charges as more precisely scheduled under the Co-operative Society Act. No one can force you to contribute for the same. There is a particular head as “Other Charges” under the classification of Society Maintenance Charges. All such has to be routed out through the same, if so desired but not separately. If your society do so, then you may make a complaint to Deputy Registrar of Co-operative Societies of your Area in writing. Regards, Adv. Sourabh A Saxena.

Q2. Can sisters claim a share in fathers property after his death. I have two brother and we are two sisters. My dad passed away in 2006 and mum is 2006 with no will, after which the property was transferred to my brothers , so now the property is on both the brothers names. Now they wish to sell the property, can the sisters claim the share in the selling??

Yes, daughters. Do claim their right in fathers property. law guarantees you your right, and you have the right to opt for due legal action against your brothers and have an objection and stay in said matter for not creating third-party rights until your shares have been specified.

Q3. What is the procedure to file a PIL? How can I file PIL in Bombay? High court against Pune municipal corporation and Irrigation department? Is it require sending notice 2 months prior to it? Can I file PIL just by sending Letter to Chief justice of Bombay high court? and how would i able to know whether it is accepted as PIL or not?

PIL is a petition its like a case before court of law considering the wrong done to public and for the sake of usti e of masses it shld b in a proper format covering all due legal points no notice nor letter is required once u file the PIL den only u ll send a notice of the same to opposite parties feel free to b in touch Regards.
