Legal Articles
Q1.How does tenancy transfer work after the demise of both tenant parents, especially if the landlord is declared ex-parte in court?.
Advocate Sameer Jagtap answered:
If both parents have passed away, an NOC from the other legal heirs is required to transfer the tenancy. The landlord will then execute a tenancy agreement, which is mandatory to get registered. An ex-parte order arises only if the landlord has filed a suit and no one appears after receiving summons.
Q2. What can be done if flat owners harass and threaten senior citizen residents over disputed terrace rights?
Advocate Sameer Jagtap answered:
A police complaint should first be filed regarding unauthorized entry and threats. A legal notice can then be sent demanding they stop such actions, and if necessary, a suit can be filed in court to restrain them, especially since the contract clearly specifies terrace rights belong to the building owner.
