Q1. False Domestic violence case filed by wife in police station. Wife had lately (march 2025) started psychiatric medicines and left the course halfway. Previously wife was housewife. Then suddenly took unilateral decision (june 2024) to join job disturbing family set-up. Wife not follow Counsellor suggestion also. She then want me to spend for her personal expenses also. I did not agree. She now file false DV case in police station against me and family members. Police send notice to me n family to submit statement/evidence. How to deal? Will police arrest?

domestic violence case is quasi criminal in nature. you need to hire a lawyer to help u in filing a detailed statement and reply to all the allegations made by your wife and vice versa u can also file for a divorce if u don’t wish to continue the relationship.

Q2. Unable to sell 2BHK flat as 2 daughters are demanding equal share. I am senior Citizen and have 1 son and 2 daughters. The share certificate has been issued jointly in both names in 1986. My late husband had made a nomination 100% in my name. If the property gets sold I wished to keep 50% of the sale proceeds of the flat and the remaining 50% to be shared equally by myself, my son and 2 married daughters. But my two daughters are not accepting my offer eventhough they have not made any contribution and are demanding equal share of the property.

you can file a suit for partition and you have all the right to sell your share of the flat. vice versa of your daughters are harassing u then can file a case against them under the welfare of parents and senior citizens act and seek maintenance as well from your kids. they will automatically come to you for settlement

yes u can go in a live in relationship but it’s not advisable if u have a child. it’s better u file for a divorce that way u can even seek maintenance and alimony from your husband for the future of your child. In a live in relationship, u will not a have any good legal standing if your live in partner abuses you or your child. plus your new partner will not have any legal obligation towards your child either
